Terms of Service

Welcome to Kotoba. By accessing or using our mobile application and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Acceptance of Terms

By creating an account or using Kotoba, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using the service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

Kotoba is a language learning application that helps users learn new languages through reading, vocabulary building, spaced repetition, and AI-powered conversation practice. We offer both free and premium subscription features.

3. Account Registration

To use certain features of Kotoba, you must create an account using Google Sign-in or Apple Sign-in. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Subscription and Payments

Kotoba Pro is our premium subscription service. By subscribing, you agree to the following:

  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscription through your App Store or Google Play account settings
  • Any unused portion of a free trial period will be forfeited when purchasing a subscription

5. Refunds

Refunds are handled by Apple (App Store) or Google (Play Store) in accordance with their respective refund policies. We do not have the ability to process refunds directly. Please contact Apple or Google support for refund requests.

6. User Conduct

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Submit content that is offensive, harmful, or violates others' rights
  • Use automated systems to access the service without permission
  • Reverse engineer or attempt to extract the source code of the app

7. Intellectual Property

Kotoba and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without express written permission.

8. User Content

You retain ownership of any content you create or upload to Kotoba (such as custom reading materials). By using our service, you grant us a non-exclusive license to store and process this content solely for the purpose of providing our services to you.

9. AI-Generated Content

Our AI language tutor provides assistance based on machine learning models. While we strive for accuracy, AI-generated content may occasionally contain errors. You should not rely solely on our AI for critical language learning decisions. We are not responsible for any inaccuracies in AI-generated content.

10. Disclaimer of Warranties

Kotoba is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or meet your specific learning goals. Your use of the service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Kotoba shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

12. Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your right to use the service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes through the app or via email. Continued use of the service after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kotoba operates, without regard to its conflict of law provisions.
